The terms and conditions listed on our website outline our way of doing business and what you can expect from us. In this document, we also tell you what we expect from you as a client and/or consumer. By using our website, Youtube channel, and/or purchasing our services, you agree to the following terms and conditions:
(i) Whenever we say the word “you,” or “the client,” it is referring to the person reading the terms and conditions, surfing through the website, watching our content, and/or purchasing our services.
(ii) When we speak of “Phantom Films,” “we,” “us,” and “our,” we mean Phantom Films Atlanta Production Company and its affiliates.
(iii) Please Note that our terms and conditions are subjected to change.
(i) Phantom Films does not endorse or promote the ads, if any are shown, on any of our websites or videos, unless stated otherwise.
(ii) Phantom Films does not share the information that you provide (via email, text, Instagram DM, or any other means of communication) unless you give consent to it.
(iii) You are solely responsible for surfing through our website, filling out forms on our website, watching our content, and/or purchasing our services.
(A) Freelance Menu
(i) By purchasing our services listed under the “Freelance Menu,” you agree to give credit to Phantom Films for its work either as a pinned comment, in the video, or in the description box
(ii) FAILURE TO FOLLOW THROUGH C(i) will result in termination of possible future collaboration with us and may lead to legal consequences.
(iii) The “Freelance Menu” is divided into different sections which are further divided into different “parts”. When purchasing our services, you can purchase any part of the Freelance Menu. By purchasing one or more parts, you agree to pay 25% upfront. The rest of the 75% must be paid prior to submitting the video to you.
(iv) The prices are also subject to change. However, if a client submits their 25% before the price change takes effect, the new prices won’t affect the client.
(v) The time it takes to complete each video differs from client to client. Once the client requests the purchase of a service, they will be notified of how long a project will take.
(vi) Phantom Films has a right to refuse service (with no refunds if applicable) if a client is being disrespectful to any Phantom Films employee, or contractors, or is engaging in making content that harms or belittles a person or a community.
(vii) Refunds can only be made on a case-by-case basis and may not be guaranteed. However, there is no possibility of a full refund if a project is halfway completed.
(viii) If a client purchases a service with One-time initiation fees they are not required to pay 25% upfront. Instead, they must pay the initiation fees first before Phantom Films can provide that service. The One-time initiation fees are non-refundable.
(ix) We use software such as Adobe Premiere Pro, Adobe After Effects, and Adobe Audition. With any service that says "Basic," we will only use Adobe Premiere Pro and Adobe Audition. For any other services that say "Advance," we will use Adobe Premiere Pro, Adobe After Effects, and Adobe Audition. PLEASE NOTE that there are limitations to VFX with the "Basic" purchase.
(B) Rental Services
(i) To rent our equipment with a security deposit, the renters MUST pay the security deposit first before initiating to schedule the equipment rentals.
(ii) If the renter damages the equipment beyond repair, the renters acknowledge the obligation to cover the entire current market price plus an additional 10% of the total market price after taxes.
(iii) If the renter damages the equipment but it is repairable, the renter acknowledges the obligation to cover the entire repair costs plus an additional 10% of the total repair costs after taxes.
(iv) In the case where the equipment is damaged by the renter, Phantom Films reserves the right to determine if the equipment needs to be repaired or replaced.
(v) The renter assumes full responsibility for the equipment provided even if they purchase the equipment with supervision service.
(vi) If the renter submits a security deposit, they are only required to pay the amount beyond the deposit amount if any damage occurs.
(vii) The security deposits are ONLY refundable when no amount of the deposit is deducted for the repairs of the equipment due to the damage caused by the renter. (viii) If the deposit is used to cover the repair/replacement damage, it is NON-REFUNDABLE even if there is a remaining balance on the deposit.
(ix) The renter assumes the responsibility to CREDIT Phantom Films as its renter in the end credits of their video projects or somewhere where the audiences can see it.
(x) The renter MUST sign a renter's agreement before renting our equipment.
(xi) The renter understands that Phantom Films holds the right to refuse services even if the equipment is scheduled for a certain date. In such cases, Phantom Films MUST give the renter a clear reason for the refusal of the service in addition to refunding any security deposit that is made before the FIRST DAY of the service.
(i) Unauthorized use or reposting of the videos without due credit and permission from Phantom Films and/or the creator is prohibited.
(ii) Unauthorized use of the website or copying and reposting any part of the website is prohibited.
(iii) Unauthorized use of original music work without the due credits from Phantom Films and/or the creator is prohibited.
(i) By giving us your contact or other information through the website or other communicational means, you agree that Phantom Films is not liable if any information is leaked or hacked through any medium.
(ii) The client who requests the services is responsible for paying the price for the services.
